Terms of service
Last updated: 12 October 2026
These terms govern use of the Sauti platform ("the Service") provided by Sauti ("Sauti", "we") to the organisation that has signed an order or agreement with us ("Customer", "you"). The signed services and data processing agreement prevails over these terms where they differ.
1. The Service
Sauti provides software for campaign communication and operations, including messaging, audience management, field operations, payments, donations, election-day coordination and reporting. Features available to you depend on your plan and on approvals by networks and providers.
2. Accounts
You are responsible for all activity under your organisation's accounts. Each user must have their own account, keep sign-in factors secure, and only receive the access their role needs. Tell us immediately about any suspected unauthorised access.
3. Your responsibilities
You must:
- have a lawful basis, and where required consent, for every person you contact;
- comply with the Data Protection Act, 2019, the Elections Act, the Election Campaign Financing Act, the National Cohesion and Integration Act, the Kenya Information and Communications Act and any guidance of the Office of the Data Protection Commissioner and the Communications Authority of Kenya;
- comply with our Acceptable use policy;
- use sender IDs only for their approved purposes.
4. Data protection
For personal data you process through the Service, you are the data controller and Sauti is your data processor. Our obligations are set out in the data processing agreement; a summary is here.
5. Fees and wallet
Messaging and usage-based services are paid from a prepaid wallet at the prices in your plan. Prices shown in the Service before a send are estimates; charges are based on actual usage. Refunds for undelivered messages follow your plan's refund policy. Commission on donations, invoices and payment terms are as set out in your plan and agreement. Overdue amounts may lead to suspension of sending or of donation pages as described in the Service.
6. Suspension
We may suspend or restrict the Service, in whole or in part, to protect people, the platform or networks, including where content is blocked by our content screen, where we receive credible complaints, during legally mandated election-silence periods, or where amounts are overdue. We will tell you the reason unless the law prevents it.
7. Availability and support
We aim to keep the Service available and to resolve incidents promptly, but the Service depends on mobile networks, payment providers and other third parties outside our control. Support is available at support@sauti.cloud.
8. Intellectual property
We own the Service. You own your content and data. You grant us the rights needed to provide the Service to you.
9. Liability
To the extent permitted by law, neither party is liable for indirect or consequential losses, and our total liability is limited as set out in your agreement.
10. Termination
Either party may end the Service as set out in your agreement. On termination we delete or return personal data according to the agreement and the retention schedule, except where the law requires us to keep it.
11. Governing law
These terms are governed by the laws of Kenya.
